Gerard Wilkes - Tax Planning

Partnership Taxation

From formation, to setting up your bookkeeping data file, our experienced firm will also provide you with partnership taxation advice, including the distribution of net profits or losses and other considerations, such as the complicated tax laws.  We can prepare your Partnership income tax returns and financial statements and discuss the appropriateness of this structure relative to your business goals.

Trust Taxation

Trusts are widely used for business and investment purposes.  With over 40 years behind us, our firm has extensive experience with discretionary family, unit, hybrid and testamentary trusts.  We will inform the Trustees of their obligations and will attend to all of the annual trust distribution resolutions/minutes and prepare the year end accounts.  Trust taxation law can be very complicated but you can be assured that our trusted team will guide you through the processes from formation, tax planning, tax preparation and any other tax issues.

Company Taxation

As registered ASIC and Taxation Agents, we can deliver a suite of services to company Directors and Shareholders, including structure, detailed company tax advice, franked and unfranked dividends, Directors loans/Division 7A loans, implementation of loan agreements and other matters. There are several pitfalls when using companies and we can help to ensure that you comply with the relevant tax and other laws.

 SMSF Taxation

Self-managed super funds (SMSFs) are a way of saving for your retirement.  The difference between an SMSF and other types of funds is that the members of an SMSF are usually also the trustees. This means the members of the SMSF run it for their benefit and are responsible for complying with the super and taxation laws.  Our experienced team can provide advice to members and trustees, from set up, contribution caps, capital gains tax, administration and other complex superannuation tax issues.

We can provide the advice and guidance to help you fulfil your duties and obligations, keeping in line with the ever changing SMSF tax laws.

GST

Goods and services tax (GST) is a broad-based tax of 10% on most goods and services sold or consumed in Australia.  Our team can guide you through the registration process and provide comprehensive GST advice to individuals, partnerships, trusts companies and self-managed superannuation funds.

Private Binding Rulings

A private ruling is binding advice that sets out how a tax law applies to you in relation to a specific scheme or circumstance.  As registered Tax Agents, we can draft and apply for the ruling and deal directly with the Taxation Office to interpret the legislation.

CGT

Another difficult area of taxation is Capital Gains Tax.  We can advise on the various ways to reduce or completely eliminate this tax.  On many occasions we have successfully reduced the tax that that would have been payable had our clients not consulted us.  We liaise with pre-eminent commercial lawyers whenever necessary to ensure legal compliance.

FBT

Fringe benefits tax (FBT) is a tax that employers pay on certain benefits they provide to their employees – including their employees’ family or other associates.  The benefit may be in addition to, or part of, their salary or wage package.  In many cases, this facet of taxation is neglected and so together with our clients, we identify if a business is affected by FBT to ensure they are registered correctly with the Tax Office and report accurately. We will also point out the pitfalls of noncompliance.
